Fees

Several types of fee arrangement exist.

  • When the heirs are unknown and are unaware of their rights, an inheritance revelation and disclosure contract is offered to the heirs who are found, which provides a fee corresponding to a percentage of the successoral amount. This contract provides that Westrich Gen SA shall assume all risks, in particular if the liabilities of the estate exceed the assets.

  • If certain heirs are aware of their rights, a contract of representation and to search for all the heirs is proposed to them. The percentage principle is the same as for the inheritance disclosure contract.
  • Outside of these cases and in special situations, Westrich Gen SA may propose, on quote, a flat-rate fee to the person requesting the search. This is often useful when the notary only needs to know the heirs, for example to deliver a legacy.

The mandate

The contracts proposed by Westrich Gen SA to the heirs it finds always provide that, as an additional service, one or several persons working for the Company may represent them in the settlement operations.

This means that the heirs do not need to travel to sign deeds, attend public auctions or for any other steps of the file.

In any case, the mandate of the heir will not prevent him/her from participating in all or part of the operations to settle the estate (inventory, signature of deeds, auctions, etc.).

The mandates proposed do not contain any specific fee. They are free additional services included in the contract, unless otherwise specified.

In any event, the express agreement of the heirs is requested for any disposal: partition of furniture, sale, etc.
